Pakistan votes to amend rape laws

Pakistan's national assembly has voted to amend the country's strict Sharia laws on rape and adultery.



Until now rape cases were dealt with in Sharia courts. Victims had to have four male witnesses to the crime - if not they faced prosecution for adultery.



…A woman is raped every two hours and gang-raped every eight hours in Pakistan, according to the country's independent Human Rights Commission. Correspondents say these figures are probably an under-estimation as many rapes are not reported.



Pakistan's religious parties called the legislation "a harbinger of lewdness and indecency in the country", and against the strictures of the Koran and Sharia law.



Rape and adultery in Pakistan are dealt with under the Hudood Ordinance, a controversial set of Islamic laws introduced from 1979 by Gen Zia-ul-Haq. They include sections prescribing lashing and stoning as punishments for adultery.



Campaigners say Pakistan's laws have made it virtually impossible to prosecute rape. Attempts to pass a new bill failed in September in the face of angry opposition.

The reform has been seen as a test of President Musharraf's stated commitment to a moderate form of Islam.



…"It is a historic bill because it will give rights to women and help end excesses against them," Prime Minister Shaukat Aziz told parliament after the vote. Religious parties boycotted the vote, saying the bill encouraged "free sex". (Read the story here.)



Rape is never a case of lewdness on the woman’s part. Muslims really need to learn the meaning of word. It is, however, a case of lewdness on the rapist’s part. And it is a manifestation of the Muslim male’s hatred of women and belief that females just exist for their own use just like their prophet Muhammad did. It also sounds to me like Muslim men just want to continue to have free license to rape women any time they want, just like their prophet Muhammad did. It is shameful that Muslim men are so sick and cannot control themselves. They use any excuse they can for rape. We are even hearing stories of how Muslim men are raping Christian women in the Sudan today. The Hypocrisy of Islam and Muslims, when they say the West is promiscuous. Yet they think they should have freedom to rape any time they want. And they have the example of Muhammad, the Hadiths and Sharia Law to back them up. That is just 7 links out of hundreds of them. But let’s examine what the Islamic view is of these kinds of rape from the Quran, Hadiths and the writings of Islamic Scholars.

And forbidden to you are wedded wives of other people except those who have fallen in your hands (as prisoners of war) . . . (Maududi, vol. 1, p. 319). (See also Suras 4:3 and 33:50) In other words, ok for Muslim men to take women captive and rape them.



The Islamic legal manual ‘Umdat al-Salik, which carries the endorsement of Al-Azhar University, the most respected authority in Sunni Islam, stipulates: “When a child or a woman is taken captive, they become slaves by the fact of capture, and the woman’s previous marriage is immediately annulled.” Why? So that they are free to become the concubines of their captors. The Qur’an permits Muslim men to have intercourse with their wives and their slave girls: “Forbidden to you are ... married women, except those whom you own as slaves” (Sura 4:23-24).



Abu Sa'id al-Khudri said: The Apostle of Allah sent a military expedition to Awtas on the occasion of the battle of Hunain. They met their enemy and fought with them. They defeated them and took them captives. Some of the Companions of the Apostle of Allah were reluctant to have intercourse with the female captives in the presence of their husbands who were unbelievers. So Allah, the Exalted, send down the Qur'anic verse: "And all married women (are forbidden) unto you save those (captives) whom your right hand possess."[Surah 4:24] ...Sunan Abu Dawud, Book V, Chapter 711, Number 2150



“A slave is the property of his/her master. He/She is subject to the master's power, insomuch that if a master should kill his slave he is not liable to retaliation. With female slaves a master has the mulk-i-moot at, or right of enjoyment, and his children by them, when acknowledged, have the same rights and privileges as his children by his wives. A slave is incompetent to anything that implies the exercise of authority over others. Hence a slave cannot be a witness, a judge, or an executor or guardian to any but his master and his children. A slave cannot inherit from anyone, and a bequest to him is a bequest to his master.” p. 367_Digest of Islamic Law_ N. Bailli e, Premier Book House (Pakistan).



'Omar [one of the Khalifs] was once talking when his wife interjected, so he said to her: 'You are a toy, if you are needed we will call you.'"[21] And 'Amru Bin al-'Aas, also a Khalif, said: "Women are toys, so choose."[22]



This was not just 'Amru Bin al-'Aas and 'Omar's opinions. Mohammad himself said:
'The woman is a toy, whoever takes her let him care for her (or do not lose her)."[23]



The belief that a woman is a toy is of vital importance for the spiritual well being of a man. For according to the great philosopher Ghazali:



"In the company of women, looking at them, and playing with them, the soul is refreshed, the heart is rested, and the man is strengthened to the worship of God...this is why God said: 'That he might rest in her.' (Q. 7:189)"[24]

Women are viewed in Islam as just being a toy for a man’s pleasure and to be used by a man any time he pleases. Then there is the belief that a woman, who is just a toy after all, must stay in her house and covered or this warrants a rape by the Muslim man.

Quran-(33:59)---“ O Prophet ! Tell Thy wives and daughters. And the believing women, that they should cast their outer garments over their persons (face) when abroad, that is most convenient, that they should be known (as such) and not molested. And God is oft-Forgiving, most merciful.”

But Sheik Taj el-Dene Elhilaly probably stated the Muslim man’s view of rape the best in his Ramadan sermon:

Australia's top Muslim cleric rationalized a series of gang rapes by Arab men, blaming women who "sway suggestively," wear make-up and don't cover themselves in the tradition of Islam.
Sheik Taj el-Dene Elhilaly's comments in a Ramadan sermon in a Sydney mosque have stirred a furor in the country with even Prime Minister John Howard weighing in with condemnation.
The cleric also said the judge in the case, who sentenced the rapists, had "no mercy."
"But the problem, but the problem all began with who?" he said, referring to the women victims – whom he said were "weapons used by Satan."

"If you take out uncovered meat and place it outside on the street, or in the garden or in the park, or in the backyard without a cover, and the cats come and eat it ... whose fault is it, the cats or the uncovered meat?" the sheik said in his sermon. "The uncovered meat is the problem. If she was in her room, in her home, in her hijab, no problem would have occurred."

Rape is the norm in Islam. It is used to humiliate non-Muslim women. It is used to punish any woman that they perceive as being “uncovered.” It is used to fulfill their lusts. But after all they are just following their Prophet who as the Quran States:

And surely thou hast sublime morals" (Quran 68.4) and “Indeed in the Messenger of Allah you have a good example to follow" (Quran33.21).
